Terms and Conditions for Non Pay Per Click Packages

This agreement is between You, referred from now as "Company", and 1stSearchRanking.com, referred from now on as "Consultant".

The company hereby employs consultant to improve the ranking of the company's web site in the search engines in accordance with the following terms and conditions:

1. The company shall pay the consultant 100% in advance.

2. Upon receipt of payment from the company, the consultant will start optimizing the company's web site for the search engines.

3. The company may choose between 6 packages: a Bronze Package, a Silver Package, a Gold package, a Diamond Package, a Platinum Package, and a Super-Premium Package.

4. If the company wishes to purchase the Bronze Package, it will pay the consultant $1499. In this case, the consultant will optimize the company's web site for 5 keywords. The consultant guarantees that it will attain at least 4 top 10 positions for the company within 6 months from the time that the company orders the consultant's services. If the consultant fails to achieve at least 4 top 10 positions within 6 months, the consultant will return $1499 to the company. If the consultant achieves more than 4 top 10 positions for the company after 6 months, the company need not pay anything extra to the consultant.

5. If the company wishes to purchase the Silver Package, it will pay the consultant $1999. In this case, the consultant will optimize the company's web site for 10 keywords. The consultant guarantees that it will attain at least 8 top 10 positions for the company within 6 months from the time that the company orders the consultant's services. If the consultant fails to achieve at least 8 top 10 positions within 6 months, the consultant will return $1999 to the company. If the consultant achieves more than 8 top 10 positions for the company after 6 months, the company need not pay anything extra to the consultant.

6. If the company wishes to purchase the Gold Package, it will pay the consultant $2499. In this case, the consultant will optimize the company's web site for 15 keywords. The consultant guarantees that it will attain at least 12 top 10 positions for the company within 6 months from the time that the company orders the consultant's services. If the consultant fails to achieve at least 12 top 10 positions within 6 months, the consultant will return $2499 to the company. If the consultant achieves more than 12 top 10 positions for the company after 6 months, the company need not pay anything extra to the consultant.

7. If the company wishes to purchase the Diamond Package, it will pay the consultant $2999. In this case, the consultant will optimize the company's web site for 20 keywords. The consultant guarantees that it will attain at least 16 top 10 positions for the company within 6 months from the time that the company orders the consultant's services. If the consultant fails to achieve at least 16 top 10 positions within 6 months, the consultant will return $2999 to the company. If the consultant achieves more than 16 top 10 positions for the company after 6 months, the company need not pay anything extra to the consultant.

8. If the company wishes to purchase the Platinum Package, it will pay the consultant $3499. In this case, the consultant will optimize the company's web site for 25 keywords. The consultant guarantees that it will attain at least 20 top 10 positions for the company within 6 months from the time that the company orders the consultant's services. If the consultant fails to achieve at least 20 top 10 positions within 6 months, the consultant will return $3499 to the company. If the consultant achieves more than 20 top 10 positions for the company after 6 months, the company need not pay anything extra to the consultant.

9. If the company wishes to purchase the Super-Premium Package, it will pay the consultant $3999. In this case, the consultant will optimize the company's web site for 30 keywords. The consultant guarantees that it will attain at least 24 top 10 positions for the company within 6 months from the time that the company orders the consultant's services. If the consultant fails to achieve at least 24 top 10 positions within 6 months, the consultant will return $3999 to the company. If the consultant achieves more than 24 top 10 positions for the company after 6 months, the company need not pay anything extra to the consultant.

10. No refund will be issued under any circumstances before 6 months from the time that the company has placed the order with the consultant.

11. The consultant shall not optimize the company's web site for single word keywords. The consultant shall only optimize the company's web site for multiple word keywords.

12. The number of top 10 positions that the consultant has obtained for the company will be calculated on the basis of the positions that the consultant has managed to obtained for the company's web site in the major search engines and directories, i.e. AltaVista, AOL, Fast, Google, HotBot, IWon, Lycos, MSN, Netscape, Open Directory and Yahoo!.

13. The copyright to the pages created or modified by the consultant will belong to the company. However, if the company makes any changes to these pages without the advice of the consultant, the consultant will not be responsible for the consequences. If the company makes changes to these pages without the advice of the consultant and if the company's site fails to achieve the guaranteed number of top 10 positions in the search engines within the stipulated time period, the consultant will not be liable to issue any refunds to the company.

14. Because of frequent changes made by the search engines in the methods by which they rank sites, the consultant does not guarantee that the search engine positions that the consultant has obtained for the company will be permanent.

15. In order to create the optimized pages for the company, the consultant may ask the company for some content related to the company's site. The company will promptly provide the consultant with the content required by the consultant.

16. Whenever the consultant recommends certain modifications to the design or content of the company's web site in order to improve the position of the company's web site in the search engines, the company will promptly make such modifications. If the company fails to make all the modifications recommended by the consultant, the guarantee period of 6 months as mentioned in clauses 4, 5, 6, 7, 8 and 9 in this agreement will be extended by as much time as is taken by the company to make the changes recommended by the consultant. If the company has not made all the changes required by the consultant, no refund will be issued under any circumstances before the extended guarantee period expires, notwithstanding what has been mentioned in clauses 4, 5, 6, 7, 8,  9 and 10 in this agreement.

17. The consultant will not divulge information related to the personal or financial affairs of the company to any third party unless specifically instructed to do so by the company.

18. The consultant will not optimize any adult oriented sites or sites in any language other than English. If an order is placed for an adult oriented site or a site which has content in a language other than English, the order will be cancelled. The amount paid by the company will be refunded, after deducting any credit card processing costs that the consultant had to incur in order to process the order.
